What Is a Category E GAL?
A Category E Guardian ad Litem (GAL)/Evaluator is appointed by the Massachusetts Probate and Family Court to investigate and evaluate facts in cases involving the care and custody of minor children and other matters involving the interests or rights of children.
The GAL gathers information, evaluates the issues identified by the Court, and reports findings to the Court. When qualified to do so, the GAL may also provide clinical opinions to assist the Court in making decisions concerning the welfare of a child.
Why This May Be a Great Opportunity for LMHCs
Mental health counselors bring valuable clinical skills to forensic evaluation, including clinical interviewing, assessment, family-systems knowledge, understanding of child development, evaluation of mental-health concerns, review of collateral information, clinical writing, and communicating complex information clearly.
What Does a Category E GAL Do?
Investigate
Gather relevant information through interviews, records, collateral sources, and other appropriate sources identified by the Court's order.
Evaluate
Use appropriate clinical knowledge and expertise to evaluate the issues specifically identified by the Court.
Report
Prepare an accurate, balanced, objective, and professional report addressing the areas designated in the Court's appointment order.
Participate in Court Proceedings
Be available for possible deposition and trial participation when required as part of the GAL's responsibilities.
What Types of Issues May Be Evaluated?
Depending on the Court's order, Category E GAL evaluations may address matters involving the interests, rights, care, or custody of children.
Child custody and parenting time
Modification of custody or visitation
Parental fitness
Guardianship matters
Removal of a child from Massachusetts
De facto parent-child relationships
Paternity of a minor child
Other matters involving the rights and interests of a minor child
Do You Meet the Basic Requirements?
Massachusetts Court materials identify specific eligibility, experience, training, insurance, and professional requirements for Category E clinicians.

You are a licensed mental health counselor in good standing.

Relevant post-licensure experience:
You meet the Court's experience requirements for Category E clinicians, including the required Massachusetts experience after licensure conducting clinical evaluations and/or providing therapy to family members involved in or subject to qualifying court proceedings.

Professional liability insurance:
You have professional liability coverage meeting the Court's required minimum.

Criminal-history requirement:
You meet the Court's requirements concerning felony convictions.

Required education and training:
You have completed the educational and training requirements established by the Probate and Family Court.

Important:
Meeting the eligibility requirements does not guarantee appointment to a particular case. A Category E GAL must have the appropriate expertise for the issues involved, remain impartial, avoid conflicts of interest, and determine whether they can complete an appointment within the Court's required time frame.

An Important Difference: GAL vs. Therapist
A Category E GAL serves in an independent forensic role. The GAL's responsibility is to investigate and evaluate the issues identified by the Court and provide an objective report. The GAL does not serve as a therapist or advocate for a party.
Massachusetts standards require the GAL to remain impartial and address potential conflicts of interest. The standards also prohibit the GAL from providing mental-health, legal, mediation, parenting-coordination, or other professional services to a party or child during the evaluation or pendency of the case.
